| Announcement No.34, 2008 of Ministry of Commerce on Initiation of Anti-dumping Investigation: Gas chromatograph-mass spectrometer from Japan |

On April 22, 2008, Ministry of Commerce received a petition filed in proper form by EAST&WEST Analytical Instruments, Inc., who represents China domestic Gas chromatograph-mass spectrometer (hereafter referred to as GC/MS) industry to apply for anti-dumping investigation on imported GC/MS originating from Japan.
In accordance with relevant regulations of the REGULATIONS OF THE PEOPLE’S REPUBLIC OF CHINA ON ANTI-DUMPING, Ministry of Commerce carried out relevant examinations on petitioner qualifications, related conditions of investigated products, related conditions of same category products as well as influences of investigated commodities on domestic industry. In addition, Ministry of Commerce examined and approved evidences listed in the petition such as dumping, injury, and causal link between the two. Preliminary evidences indicated the petition was qualified for applying for anti-dumping investigation on related domestic industries in accordance with Article 11, Article 13 and Article 17 of the REGULATIONS OF THE PEOPLE’S REPUBLIC OF CHINA ON ANTI-DUMPING. The petition also contains required contents and related evidences of Article 14 and Article 15 of the REGULATIONS OF THE PEOPLE’S REPUBLIC OF CHINA ON ANTI-DUMPING on initiation of anti-dumping investigation.
In terms of the above examination results and Article 16 of the REGULATIONS OF THE PEOPLE’S REPUBLIC OF CHINA ON ANTI-DUMPING, Ministry of Commerce decides to initiate an anti-dumping investigation against the imported GC/MS originating from Japan. Relevant matters are now announced as follows:
The period of investigation is Jan 1, 2007 to Dec 31, 2007 and the industry injury investigation period is Jan 1, 2005 to Dec 31, 2007.
The scope of the investigation is imported GC/MS originating from Japan (whether assembled or unassembled, complete or incomplete), and certain main parts be used to assemble GC/MS thereof, namely the gas chromatography systems, the ion source, the mass analyzer, the detector, the vacuum system and the computer system, and any combination thereof. GC/MS is under items 90272011, 90275000, 90278019 and 90278099 in PRC Customs Import Tariff Code.
This investigation starts on Jun 5, 2008, and usually will be ended before Jun 5, 2009. It may be prolonged to Dec 5, 2009 in case of particularity.
